Zoopy has been created for everyone! But, as life goes, you'll need to accept that if you didn't create it - or buy it - you have no ownership over it.

The content on Zoopy (except all Member Submissions - as defined below) including (but not limited to) the text, software, scripts, graphics, photos, sounds, music, videos, interactive features, trademarks, service marks and logos, are all owned by or licensed to Zoopy and are subject to copyright and intellectual property rights under South African and foreign laws, and international conventions.

You, and you alone, are responsible for your own member submissions as well as the consequences of posting or publishing them – whether you created them or not. By accepting this agreement, you affirm that:

a) you own or have the necessary licenses, rights, consents, and permissions to use and authorise Zoopy to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and submissions you make, to enable their inclusion on the site and that;

b) you have the written consent of each and every identifiable individual person in your submissions to use their name and/or likeness and to publish the media on Zoopy. Please understand that whether or not the submission is published, Zoopy cannot, and does not, guarantee any confidentiality with respect to any submissions.

So for clarity, you will retain all of your ownership, copyright and all other proprietary rights in your member submissions. However, by submitting your videos, photos and other content to Zoopy via our website or any other means, you grant Zoopy a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the Member Submissions in connection with the Zoopy Website and Zoopy's (and its successor's) business, including without limitation for promoting and redistributing part or all of the Zoopy Website (and derivative works thereof) in any media formats and through any media channels.

You also hereby grant each user of the Zoopy Website a non-exclusive license to access your submissions through browsing the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such member submissions as permitted through the functionality of the Website and under these Terms of Service.

The foregoing license granted by you terminates once you remove or delete a submission from the Zoopy Website - which you are able to do at any time.

Furthermore, you agree that you will not:

a) submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material;
b) publish falsehoods or misrepresentations that could damage Zoopy or any third party;
c) submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offense, give rise to civil liability, or is otherwise inappropriate;
d) post solicitations of business;
e) impersonate another person.

Zoopy does not endorse any Member Submission or any opinion, recommendation, or advice expressed therein, and Zoopy expressly disclaims any and all liability in connection with member submissions.

Zoopy also reserves the right to decide whether content or a member submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to, pornography, obscene or defamatory material, or excessive length. Zoopy may remove such content and/or terminate a member's access for uploading such material – without prior notice and at its sole discretion.

Zoopy does not condone any form of copyright infringement whatsoever. We take all measures we reasonably can to ensure this does not happen but can never guarantee this so:

If you are a copyright owner or an agent of a copyright owner, and believe that any member submission or other content submitted to or displayed on the Zoopy Website, please submit a notification to copyright@zoopy.com with the following information in writing:

a) A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed;
b) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
c) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;
d) Information reasonably sufficient to permit Zoopy to contact you, such as an email address, a physical and postal address, telephone number, and, if available, fax and mobile numbers;
e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, their agent(s), or the law – either of South Africa, or the country you reside in;

You further understand and acknowledge that you may be exposed to member submissions that are inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Zoopy with respect thereto, and agree to indemnify and hold Zoopy, its owners/operators, affiliates, and/or licensors, harmless to the fullest extent allowed by law regarding all matters related to your use of the site.

Zoopy does however provide mechanisms allowing you to report such content as offensive, upon which it will immediately be removed and reviewed for re-inclusion / permit exclusion from the website.

Zoopy hereby permits you to link to materials on the website for personal, non-commercial purposes only.
